New Cloud SIG launched
Reflecting the growth in online business applications, a number of BASDA members have set up a Cloud special interest group (SIG) with a view to raising the profile of business Cloud computing applications, exploring ideas around standards and best practice and producing deliverables that benefit both members, partners and end users.
The first meeting, held on 16th June, attracted a wide range of members – from both traditional business application suppliers moving into online business applications and newer online application vendors - who discussed at some length the issues surrounding online business software, a sign of the overall industry interest in the Cloud computing arena.

Re-launch of eBusiness SIG
Activity is being revived in the BASDA eBusiness SIG, with the first 2009 meeting held on 2nd July.
As well as electing Tim Cole of Causeway as Chair and Ronald Duncan of @UK as Deputy Chair, the agenda covered a review of the OB10 patent application and a discussion on the EU Directive on e-Invoicing.

BASDA lobbies HMRC for flexibility on new online Corporation Tax Filing
As a result of Lord Carter’s government report and recommendation to increase the use of its online filing systems, HMRC are introducing compulsory online filing for Corporation Tax from 1 April 2011 for any accounting period ending after 31 March 2010, where all Company Tax Returns must be filed online with accompanying computations and accounts in iXBRL format.
HMRC are advising customers that they will be able to submit this data directly from their own software into HMRC's systems and that they will need to make sure their software will be able to file their returns using the iXBRL format by April 2011. Over ¾ of CT filings come via intermediaries (i.e. agents & accountants) and the majority of these use commercial software.
BASDA, in protecting the best commercial interests of its members, is lobbying at a very senior level within HMRC - highlighting the significant pressure this puts on the software vendors along with tax agents, accountants and end businesses.
The technical specifications have only been made available in the last few months and, having conducted analysis in liaison with members, agents and accountants, BASDA concludes that this will have a major impact on its members and the wider industry:
- There is concern regarding the very new technology (iXBRL) that HMRC are asking members to use, which involves a significant development workload (and accompanying skill set).
- There are also considerable overheads on the data structures required to submit these data files – via a set of structured data dictionaries, called taxonomies – and so concerns as to making them fit-for-purpose and clarity around exception handling.
- Implementation of this new technology could be a severe distraction to developers and their customers and, therefore, a risk to commercial business revenue.
- There are also potential changes to overall accounting structures for small businesses over the next few years plus Companies House are likely to modify their online filing (to a similar XBRL) so these need to be clarified and planned well in advance to minimise disruption for all.
- There will be notable changes to the agents/accountants/customer’s business processes and so requiring investment in upgraded systems, testing and training plus there may well be issues of accountability where agents will have to translate accounts data into iXBRL.
- HMRC have also only focused upon CT software vendors but it is also clear that accounts production vendors are key in the success here (due to the above generation of accounts data into iXBRL).
- There is a general concern as to how ready the HMRC systems will be to effectively handle this data and effectively analyse the data and so, derive meaningful benefits.
- Finally, BASDA is fully committed to a highly effective and efficient government but it is concerned that the only beneficiaries here are HMRC and the costs are effectively being placed upon the software industry, its clients (agents & accountants) and the end business customers.
BASDA’s Chairman (Kevin Hart) has championed this issue and working in close conjunction with the TASSA SIG Chairs, he has most recently shared all of the key problems along with a recommended way forward with HMRC and is due to attend a high level meeting this summer. From this, BASDA hopes to achieve some flexibility from HMRC in terms their expectations and so reduce the wider industry’s risk exposure.

HR & PAYROLL SIG:
Another Victory for BASDA!
In the middle of March the Scottish Parliament passed a Order to alter the way in which Court Orders are calculated when deducted from the payroll. This order was to take affect from the 6th April this year. As software had already been distributed by our members for their customers to use from the 6th April, it was far to late to make alterations.
BASDA and a few other payroll related organizations wrote to the Scottish Parliament point out the errors of their ways and fortunately they listened and withdrew the legislation.
They have now decided that they will introduce the changes in April 2010 after making a few further changes suggested by BASDA. These are based around a minimum payment and defining the rounding rules to the calculations, as the existing rules could mean an employer would have to hand over as little as 1p a month.

FINANCIALS SIG:
Clarification of new tax point rules for intra-EU Services
We have now received further guidance from HMRC on the change to Tax Point rules for intra-eu services. These new rules come into effect on 1st January 2010 and move the tax point date away from Invoice date to Payment or service completion date.
Within the guidance provided by HMRC they now state…
“In many cases this may well be the date of the supplier’s final invoice. However, equally in others, the invoice might not necessarily represent the most accurate indicator of the date of completion. For example, where a supplier is known to routinely issue final invoices two weeks in advance of completion it would be more accurate to identify completion as the date of the invoice plus two weeks. As a general principle we will accept reliance on an invoice date or any other methodology provided it does not produce a manifestly inaccurate result. Ultimately it is up to individual businesses to identify the most accurate methodology for their particular circumstances.”

VAT account values to be held to 4 decimal places ?
HMRC has recently issues draft guidance on addressing the issues of rounding of VAT values. Amongst the guidance provided is an expectation that VAT values, held in the VAT account, will be held to 4 decimal places. For full information please go to the BASDA Financials SIG Forum.

BASDA responds to Migration Advisory Committee consultation on proposals from the Home Secretary to apply new controls in respect of requests for visas for 'Tier Two' applicants
The proposals apply to 'Tier Two' applicants - non-EU national in the context of an intra-corporate transfer (ICT) into the UK.
Any move to restrict ICT Tier 2 permits to only those jobs on the shortage occupations list will have a negative impact on the UK economy and will be detrimental to the IT Industry’s ability to do business.
The project based employees bring specialist skills to UK projects and allow companies to resource their projects efficiently. Restricting the ability to bring these specialists to the UK will have the effect of encouraging employers to work offshore with the resulting negative impact on UK resident workers.
ICTs are central to the manner in which many companies carry out business and as transferred workers are fully familiar with the company systems etc they are highly effective resources.
